NetQuall Technologies has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved Privacy Shield complaints concerning data transferred from the EU and Switzerland.
NetQuall Technologies collects certain Personal Data such as name, email address, postal address and telephone number. We do not collect sensitive Personal Data of consumers, customers or suppliers, such as information about medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or other sensitive information as defined by the Privacy Shield framework.

An individual who decides to invoke this arbitration option must take the following steps prior to initiating an arbitration claim: (1) raise the claimed violation directly with the organization and afford the organization an opportunity to resolve the issue within the timeframe set forth in Section III.11(d)(i) of the Principles; (2) make use of the independent recourse mechanism under the Principles, which is at no cost to the individual; and (3) raise the issue through their Data Protection Authority to the Department of Commerce and afford the Department of Commerce an opportunity to use best efforts to resolve the issue within the timeframes set forth in the Letter from the International Trade Administration of the Department of Commerce, at no cost to the individual. This arbitration option may not be invoked if the individual’s same claimed violation of the Principles (1) has previously been subject to binding arbitration; (2) was the subject of a final judgment entered in a court action to which the individual was a party; or (3) was previously settled by the parties.
In addition, this option may not be invoked if [an EU Data Protection Authority or the Commissioner] (1) has authority under Sections III.5 or III.9 of the Principles; or (2) has the authority to resolve the claimed violation directly with the organization. [A DPA’s/the Commissioner’s] authority to resolve the same claim against [an EU or a Swiss] data controller does not alone preclude invocation of this arbitration option against a different legal entity not bound by the [DPA/Commissioner’s] authority.

Our commitments under the Privacy Shields are subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission. We may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Under such circumstances, we may be prohibited by law, court order or other legal process from providing notice of disclosure.
We may use a limited number of third party service providers to assist us in providing services to our customers or to meet internal business needs.
Currently we are using two third-party tools:
Sendgrid – used for sending emails and Twilio – used for sending SMS through the application. These third parties may access, process, or store personal data in the course of providing their services. We maintain contracts with these third parties to restrict their access, use, and disclosure of personal data in compliance with our Privacy Shield obligations, and we may be liable for such parties if they fail to meet these obligations.
We do not rent or sell your Personal Information to anyone. We may share and disclose information (including Personal Information) about our customers in the following limited circumstances:
Vendors, consultants, and other service providers:
We may share your information with third party vendors, consultants, and other service providers who we employ to perform tasks on our behalf. These companies include (for example) our payment processing providers, website analytics companies (e.g., Google Analytics), product feedback or help desk software providers, CRM service providers (e.g., Salesforce), email service providers, and others.
If NetQuall Technologies has received your Personal Information in the United States and subsequently transfers that information to a third party agent or service provider for processing, NetQuall Technologies shall remain responsible for ensuring that such third party agent or service provider processes your Personal Information to the standard required by our Privacy Shield commitments. Unless we tell you differently and you consent, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.
Protection of NetQuall Technologies and Others:
We reserve the right to access, read, preserve, and disclose any information as necessary to comply with law or court order; enforce or apply our agreements with you and other agreements; or protect the rights, property, or safety of NetQuall Technologies, our employees, our users, or others.

NetQuall Technologies also protects Personal Data through the use of firewalls, role-based restrictions and, where deemed appropriate by NetQuall Technologies, encryption technology. Individuals who have been granted access to Personal Data will be made aware of their responsibilities to protect such information and will be provided training and instruction on how to do so.

Other Users Designated by You: If you invite others to access, use, or edit content you create through Netquall application(s), we will make such mntent available to the individuals you invited.
Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party (upon prior approval from the user).
By entering into our User Agreement, you agree that, with respect to other user’s personal information that you obtain through Netquall Services or Netquall-facilitated transaction, Netquall hereby grants to you a license to use such information only for: (a) Netquall-related communications that are not unsolicited commercial messages, and (b) any other purpose that such a user expressly agrees to, after you tell them the purpose you would like to use it for. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this Section, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you in
Netquall and our users do not permit spam. Therefore, without limiting the foregoing, you are not licensed to add a Netquall user to your mail list (email or physical mail) without their express consent.
Retention: We shall retain your information for as long as your account is active or as necessary for legal business purposes.
Reviewing and Updating User’s Information: We offer you the ability to review and change certain information about you (such as your profile information, contact information, password and user preferences) by logging into the Netquall services (web and mobile app) and entering the new information yourself in your profile page. You must promptly update your information if it changes or is inaccurate. You can also make a request to modify information that cannot be amended or deleted through the application by contacting us (at firstname.lastname@example.org). We will take reasonable steps to permit you to modify information that is inaccurate or incomplete. We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law.
Closing Your Account:
If you wish to close your account, please send us a request at email@example.com. Upon your request, we will de-activate your account, and delete your information from our active databases. Your account will be closed as soon as reasonably possible based on your account activity and in accordance with applicable law. However, we will retain in our files and use some of your information in order to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our User Agreement and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from public and member viewing and will only be available to select Netquall personnel.
If you have shared any content or information through our Services with other users, such content or information may still be available to them if they have not also deleted it or closed their accounts.
Netquall takes all reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorized access, modification or disclosure. We employ physical, electronic, and administrative procedures based on the sensitivity of the information that we collect. While we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-parties from illegally obtaining this information, especially when accessing third party sites.

Netquall offers its visitors and users a means to choose how we may use information provided. You can stop all collection of information by requesting deactivation of your registered account/profile or uninstalling the app. You may use the standard uninstall procedure as may be available as part of your mobile device or via the mobile apps marketplace or network.
Netquall services takes children’s privacy seriously. Our products and services (including our website) are not designed for or marketed to minors. Accordingly, we do not knowingly collect, use or disclose personal information from minor’s or allow them to use our services. If you are a minor, please do not attempt to use the Netquall services or submit any personal information through our websites without the express consent and participation of a parent or guardian. Any personal information collected from a minor without verified parental consent, will be deleted as quickly as possible.
